In an interview aired on Sunday, Bill O’Reilly spoke with President Obama on a variety of topics. When asked about the recent healthcare court ruling in Florida, President Obama responded, “Well, I think the judge in Florida was wrong. Keep in mind that we’ve had 12 judges said — that just threw this case out — the notion that the health care law was unconstitutional.”
Does the statement stand up to the facts? According to PolitiFact, it doesn’t. Twelve court challenges to the healthcare legislation were in fact dismissed, but rather than ruling on the constitutionality of the ObamaCare, those cases were “were dismissed for procedural reasons, often because the judges concluded the plaintiffs either lacked proper standing or jurisdiction to bring the lawsuit.” So far, only four federal judges have ruled on the merits of cases challenging the healthcare legislation with two judges upholding the legislation and two overturning at least part of the legislation.
